New trademark registration in Myanmar accepted: Re-file old trademarks in Myanmar now
Myanmar shall accept the refiling of trademarks which were already registered in Myanmar under a former trademark system. The refiling is called “SOFT OPENING”. The article highlights the main features which trademark applicants should note about the re-filing trademark in Myanmar.
This is a very good news after a silent period after the New Myanmar Trademark Law (Union Law no. 3/2019) was enacted on 30 January 2019.
What trademarks shall be accepted during the “SOFT OPENING” period?
During the “SOFT OPENING” period, Myanmar trademark office only accepts trademark applications which were already registered in Myanmar in the former trademark filing system (existing registered trademark in Myanmar).
When shall “SOFT OPENING” period commence?
“SOFT OPENING” period shall commence at the end of December 2019.
How long is “SOFT OPENING” period?
The period of “SOFT OPENING” shall take for 03-06 months.
What should trademark applicants do during the “SOFT OPENING” period?
The owners of registered trademarks shall be required to re-file the trademark application in accordance with the new Myanmar trademark law.
What are required documents for re-filing new trademark in Myanmar?
The required documents include:
+ POA Notarised and duly legalized
+ Documents issued by The Myanmar Registration Office
+ Statement as filed to secure the previous registration
How much does it cost?
The Myanmar Trademark Office has not notified official fees.
The validity of New Trademark Registration in Myanmar?
Trademark after successful registration shall be valid for a period of 10 years.
