CNIPA Released A Promotion Plan To Boost IP Protection
The “Promotion Plan for the In-depth Implementation of the Opinions on Strengthening the Protection of Intellectual Property Rights” (hereinafter referred to as the “Promotion Plan”), published by CNIPA on November 4, 2022, includes a proposed timeframe for each task. Some important tasks and timeframes are listed below:
1. By the end of December 2022, implement the updated “Rules for the Implementation of the Patent Law of China” and “Guidelines for Patent Examination Guide” revisions.
2. By the end of December 2022, draft revisions to the “Regulations of China on the Protection of New Varieties of Plants” will be established.
3. By December 2025, reform of the utility model system will be encouraged, bringing up the issue of the blatant lack of innovation.
Prior to that, the utility model could be granted without undergoing a thorough examination. However, the CNIPA proposed improving the quality of utility models by incorporating an examination of the obvious lack of novelty starting in 2009. This time, the examination of the obvious lack of inventiveness will also be included by December 2025. The grant rate of utility models in China is expected to decrease much further in the upcoming years.
4. The trademark registration examination cycle in general cases will settle at 7 months by December 2022, while the examination time for innovation patents will be cut in half to 16.5 months.
5. Establish examination rules for the protection of new agricultural plant varieties by the end of December 2022, complete approving more than 7,000 cases and granting more than 3,000 cases of new agricultural plant varieties, and cut the examination cycle by 15 days. Create a management strategy to safeguard new forest and grass plant varieties. This is a significant step for China to start emphasizing the need to safeguard new varieties of plants and animals.
