New Trademark Law In Myanmar: What Happen To Trademark Registered Under Former Trademark System?
What happen to trademark registered under former trademark system? As reportedly the new trademark law in Myanmar was enacted and new trademark filing system shall be available in 2020 or 2021.
Requirements for application shall be consist with regulation, thus we will provide after enactment of regulation. In principle, you can find full details of requirement for new trademark in Myanmar here.
The new Myanmar trademark law is expected to come into force from 2020 or 2021. Until then the current practice is still remained for registration of Mark in Myanmar. The fee of trademark registration in Myanmar by the current practice is hereafter:

WHAT HAPPEN TO TRADEMARK REGISTERED UNDER FORMER TRADEMARK SYSTEM?
According to section (93)Sub Section (a) all registered trademark in Myanmar under previous practice shall be re-registered in accordance with adopted law and upcoming regulation.
Besides that, according to section (17), Sub Section (b-4), previous registered documents shall be attached with new application, regulatory body shall be considered as a related ground and its will support on prior right claim.
At the same time, Myanmar has been introduced “First to File” system and have not stated “Grace Period” for registered Trademarks under previous practice.
Therefore, it is necessary to refile the registered trademark in Myanmar again to protect your rights.
