New Zealand’s rule affirms the connection between copyright and relationship property
In February 2024, the Court of Appeal in New Zealand issued a significant ruling in a copyright dispute between artist Sirpa Elise Alalaakkola and her former husband, Paul Anthony Palmer, regarding paintings created during their marriage.
The court confirmed that copyrights generated during a relationship are considered relationship property under New Zealand’s Property (Relationships) Act 1976. Despite a previous High Court ruling granting Palmer joint ownership of the copyrights, the Court of Appeal overturned this decision, granting exclusive rights to Alalaakkola.
Jenni Rutter, a partner at Dentons Kensington Swan, supported the Court of Appeal’s decision, highlighting that while copyright is deeply personal to the creator, it is still subject to relationship property rules. She emphasized the need to evaluate contributions made during a relationship, including intangible assets like intellectual property.
Rutter explained that while copyright may seem inherently personal, it is often commercialized or traded, warranting its inclusion in relationship property division. The Court of Appeal’s decision aimed to balance this by granting exclusive ownership to Alalaakkola while acknowledging the copyright’s status as relationship property.
To achieve an equitable division of property, the court suggested compensatory adjustments for Palmer from other relationship assets. Nadia Ormiston, a senior associate at Dentons Kensington Swan, noted that the decision might still be subject to appeal.
The case underscores the evolving legal landscape regarding relationships and intellectual property in New Zealand. Ormiston advised creators to protect their rights through contracting agreements, especially given the ongoing development in this area of law.
As the decision could still be appealed, further clarification on copyright and relationship property issues is expected, shaping New Zealand’s legal framework in this domain.
