Vietnam National Office of Intellectual Property Tests Online Patent Registration System

Starting from November 15, 2023, the Vietnam National Office of Intellectual Property officially launches a pilot phase for the online patent registration system. Patent applicants can access the system at https://dichvucong.ipvietnam.gov.vn/ to submit their applications.

Applicants currently have the option to submit paper applications to the headquarters of the National Office of Intellectual Property in Hanoi or the two representative offices in Ho Chi Minh City and Da Nang. Alternatively, they can choose to submit applications online through the National Office of Intellectual Property’s online registration system at https://dichvucong.ipvietnam.gov.vn/.

Conditions for Online Patent Registration in Vietnam

To submit an application online, applicants must possess a digital certificate and digital signature, register an account on the online registration system, and have their account approved by the National Office of Intellectual Property to conduct industrial property ownership transactions.

Individuals eligible to practice as intellectual property representatives or organizations acting as representatives must register and be recognized by the National Office of Intellectual Property to continue administrative procedures in the field of industrial property ownership.

These conditions also apply to other methods of submitting applications for intellectual property registration.

Online Patent Registration Process

Applicants need to declare and submit their patent applications through the National Office of Intellectual Property’s online registration system. This involves providing information, uploading relevant documents, and verifying applicable fees and charges.

Applicants must digitally sign the application using their registered USB digital signature and proceed to pay the fees and charges for the patent registration application using the QR code provided by the National Office of Intellectual Property. They must then update the payment documents.

Once these steps are completed, the application is sent to the National Office of Intellectual Property for processing. If the documents and payment certificates are complete as per regulations, the receiving department of the National Office of Intellectual Property will issue a registration number on the online registration system. Incomplete documents will result in the rejection of the application.

In cases where applicants fail to complete the required fees and charges, the application will be canceled. Notifications of application acceptance or rejection will be sent to the applicant via email and updated on the online registration system.

Documents for Online Patent Registration

Patent registration applications must adhere to regulations outlined in Articles 100, 101, and 102 of the Intellectual Property Law, Part II, III, IV of Appendix I to Decree No. 65/2023/ND-CP. Required documents include:

  • Patent registration form (Form 01 in Appendix I to Decree 65/2023/ND-CP).
  • Description and patent protection requirements (including drawings if applicable).
  • Patent summary.
  • Documents proving the registration rights if the applicant enjoys the registration rights of others.
  • Documents proving priority rights if priority rights are claimed.
  • Explanation of the origin of genetic resources or traditional knowledge about genetic resources in the patent application (for inventions directly created based on genetic resources or traditional knowledge about genetic resources).
  • Power of attorney (if submitted through a representative).
  • Copies of fee payment documents (for fees paid through postal services or directly into the National Office of Intellectual Property’s account).
