Myanmar’s Industrial Design Law goes into effect on October 31, 2023
The State Administration Council (SAC) of the Republic of the Union of Myanmar published Notification No. 217/2023 on October 18, 2023, designating October 31, 2023, as the effective date of Myanmar’s Industrial Design Law 2019 (IDL).
Creators of industrial designs (Designs) can file applications for registration of their Designs with the Intellectual Property Department (IPD) beginning October 31, 2023. The IPD is likely to send notices soon determining the start date for filing Design applications, the official application form, and other paperwork, as well as the official fees.
A registrable Design must be new and original, according to the IDL. If the designs are for items in the same Locarno classification, one application can cover many Designs. To appoint a Myanmar agent to file the application, a foreign applicant must sign and submit the ID-2 Form.
Prior to the 18th of October 2023, the Ministry of Commerce issued Notification No. 67/2023 on the 29th of September 2023, outlining the rules for filing an application, description of Design, examination, amendment of application, withdrawal of application, opposition, registration, records of assignment, records of license, invalidation, and cancellation, and appointment of a representative for filing Design.
The SAC also published Notification No. 218/2023 on October 18, 2023, designating October 31, 2023, as the implementation date of Myanmar’s Copyright Law 2019 (CRL).
The CRL protects Myanmar residents’ literary and artistic creations as copyright works. The CRL also protects the works of foreigners who live in Myanmar and first publish their works there, or who first publish their works abroad but re-publish them in Myanmar within 30 days after the original publication date.
