WHY IS TRADEMARK SEARCH IN SOUTH KOREA NECESSARY?

WHAT IS THE PROCEDURE OF REGISTERING TRADEMARK IN SOUTH KOREA?
After searching and ensuring the distinctiveness of trademark in South Korea, the owner should proceed to file their trademark to The South Korea Trademark Office as soon as possible. Their application shall be processed with three stages:
– (1) Examination
In the “examination” stage, initially, the Trademark Office shall proceed to examine the application about formalities, classification and then examine it about descriptiveness, distinctiveness, deceptiveness and pre-applications which may be conflicted.
– (2) Publication
In the “publication” stage, the trademark application will be available to the public through online and publication. The information about the trademark, such as mark, name of applicant, address of applicant or their goods/services, shall be published. At that time, the others could file opposition against the holder and the opposition period shall end after two months from date of publication of the application.
– (3) Registration
When the trademark meets the requirements of examination without legitimate opposition, the holder shall be granted for the trademark registration certificate in Indonesia, which is the “registration” stage. At that time, the holder shall have total rights for their trademark.
The effectiveness of the trademark certificate is 10 years from registration date and the holder needs to renew this certificate for their trademark.
