The procedure of trademark renewal in Thailand
A trademark registration is valid for 10 years from the date of application. Since the Thai Trademark Act (No.3) came into force on July 28, 2016, renewal applications must be submitted during the 90-day period before the expiration date.
The trademark may be renewed an indefinite number of times. The New Act provides for a grace period of six months after the expiration date. The grace period cost is 20% in addition to the normal official fee.
While no declaration or evidence of use is required to retain registration, failure to use the trademark for any successive three-year period without a valid cause renders registration vulnerable to cancellation. To satisfy the use requirements, the registered owner or registered licensee must use the trademark. In the case of the non-use, any interested party may request the Trademark Committee for cancellation.
On March 1, 2021, the renewal procedure for qualifying trademarks in Thailand became considerably faster, with applications being examined and a certificate of renewal being granted within 45 minutes after being submitted. There is no extra official cost associated with the expedited process.
This is an important advance forward for the DIP, which has grown more brand-owner-friendly and business-oriented in recent years. Furthermore, it will facilitate and expedite trademark-related activities, such as trademark transfers and records of name or address changes, which may become difficult when tried while a renewal is pending.
In the case where the trademark owner does not apply for renewal of the trademark registration within the period prescribed, the registration of the trademark shall be deemed canceled.
