The fight against piracy and counterfeiting has never been easy. IPOPHL has built up its reputation as one of the top IP Office that has the most actions condemning this state. Recently, as its latest effort, the Intellectual Property Office of the Philippines (IPOPHL) has cooperated with the Content Overseas Distribution Association (CODA) to fight piracy, especially for Philippine and Japanese works in their respective countries.

A Memorandum of Understanding (MOU) has been signed between IPOPHL and the Content Overseas Distribution Association (CODA), a Japanese organization tasked with combating content piracy and promoting international content distribution.

With this agreement, IPOPHL aims to bolster the efforts made in the war against piracy in the Philippines. 

The Content Overseas Distribution Association

The Content Overseas Distribution Association (CODA) was founded as an organization through which contents holders and copyright-related organizations cooperate to reduce piracy around the world and to actively promote the international distribution of Japanese content, such as music, films, animation, TV programs, and video games. While CODA was formed to counter content piracy, the organization is now expanding its enterprise in cooperation with domestic and international government agencies, industry organizations, and content holders.

On Dec 2, 2013, CODA merged its secretariat office with that of the Anti-Counterfeiting Association (ACA) in order to strengthen its capability to protect copyright and offer comprehensive measures against copyright infringement in Japan as well as overseas.

The trademark of CODA, “CJ Mark,” is printed on packages of Japanese content and products such as music, films, animation, TV programs, video games, toys, and books. In the case of audio-visual works, the trademark also appears on them. CJ Mark is registered in 7 different countries and regions that include Japan, the United States of America, the EU, China, Hong Kong, Taiwan, and South Korea.

CJ Mark has successfully been put in use to take criminal actions in Hong Kong since 2008.

The corporate members can make use of CJ Mark once they sign a trademark licensing agreement with them.

IPOPHL’s collaboration with CODA

According to the terms in the MOU signed between IPOPHL and CODA, these organizations will collaborate in harmony to the best of their capabilities to safeguard the protection of copyrighted Philippine and Japanese works in their respective countries. 

MUSO, a pirate analytics business, found that among the top piracy sites in the Philippines, Japanese anime series and movies were one of the most pirated and downloaded subjects. 

From now on, the cooperation will streamline the flow of information, research work, statistics, and trends in both nations, therefore improving the enforcing capabilities of both countries/organizations.

In addition to the above, both agencies will also share effective enforcement tactics to prevent piracy or counterfeiting actions, such as the prevention, online piracy monitoring, rolling takedown, and site-blocking. 

IPOPHL and CODA will also participate in policy development dialogues soon with the goal of achieving their common goal of establishing greater respect for intellectual property in society, both in Japan and the Philippines, as well as in the rest of the world. 

Lastly, both organizations will seek to promote one other’s awareness and education programs in order to strengthen copyright protection.

Expert opinions

IPOPHL Director General Rowel Barba stated the importance of the cooperation between IPOPHL and CODA: “This MOU will be a game-changer in our battle against piracy. This is an issue we must quickly address amid heightened IP infringement during the epidemic.”

Takero Goto, CODA Senior Executive Director, praised IPOPHL for its “long-term dedication and successes in the preservation and promotion of intellectual property.” He stated, “By chairing the ANIEE (ASEAN Network of IP Enforcement Experts) from its inception, you have been a leader and a vital component of ASEAN.
