The issue of trademark registration with hemp and cannabis products in Thailand 

As the world develops, there is also the need to amend the current regulations that might not too suitable for the developing world. Within the IP world in Thailand, there is currently a problem with some of the plants that are not compatible with the law of this country, specifically hemp and cannabis and its products.

Cannabis and hemp have been forbidden in many countries due to their lethal products and their effect on society. 

However, in Thailand, from 2019 until now, the regulations on cannabis and hemp have been relaxed dramatically, slowly legalized these plants within Thailand’s jurisdiction. 

The gradual relaxation of the law means that one day, cannabis and hemp might be completely legalized in Thailand. This not only opens up many opportunities for the economy but also for the IP field.

If cannabis and hemp are legal, this means that the trademark registration for the words and pictures, along with other aspects of IP relating to cannabis and hemp may also be done. 

Cannabis and hemp in Thailand

In 2021, cannabis and hemp have been accepted in some parts as the active ingredients in products including food and cosmetics in Thailand due to the relaxation of the regulations on these ‘forbidden’ plants. 

Regarding medical attributions, hemp and cannabis have also proved their worth as medicinal herbs due to the presence of two main active ingredients: tetrahydrocannabinol (THC) and cannabidiol (CBD). The medical function of cannabis and hemp is one of the main reasons why these plants have been gradually accepted throughout the world, in contrast with their bad usage in the past. 

With so many potentials in the market, it is no wonder that Thailand and many other countries have slowly eased the restrictions surrounding cannabis and hemp, making the path for the development of the economy in Thailand as many entrepreneurs have caught a stench of this opportunity and accordingly, industriously including these active ingredients in a wide range of products to gain profits, for example, cannabis oils, cannabis cookies, cannabis tea, or cannabis coffee in the local markets. 

Role of cannabis and hemp in IP field in Thailand

As cannabis and hemp have been gradually accepted by the government and society, it is now possible to file trademark registration in Thailand for cannabis and hemp products. 

Accordingly, during these times, there has been a sharp increase in trademark filings for products containing hemp and cannabis by individuals and companies, both domestic and international. 

However, as for most distinctive fields in society, cause hemp and cannabis are rather in a sensitive position in Thailand, the individuals or organizations working with these plants must prove that they are capable, meaning they must have the necessary license to prove that they received authorization from local authorities to manufacture or distribute such products.

Accordingly, trademark applicants who want to register for cannabis and hemp trademark must also submit concrete proof that they received authorization from local authorities to manufacture or distribute such products to the IP Office of Thailand.
