Myanmar Trademark Law Latest Update in 2023
Following amendments to the Myanmar Trademark legislation in 2019, a soft opening to implement the updates in the law and the new electronic filing system began on 1 October 2020, with the soft opening scheduled to last 6 months until the Grand Opening.
The Myanmar Intellectual Property Department (IPD) issued the following announcement on January 12, 2023:
(a) Grand opening date- The Trademark Law (2019) is scheduled to go into effect in March 2023.
(b) Once the new law is in effect, applications for trademark registration in Myanmar will be officially accepted, including payment.
(c) A valid trademark representative in Myanmar must have a WIPO File User Account and a certificate of completion of the IPD’s trademark registration training.
(d) As a result, WIPO File User Account holders who have not previously attended IPD training sessions and those who intend to register as trademark representatives in Myanmar must complete the required training.
(f) For that purpose, in February 2023, the Trademark Registration Representative Training Course (1/2023) will be launched.
The IPD stated in the first week of April 2023 that the new Trademark Law will go into effect on 1 April 2023, with Phase Two of the soft opening period beginning on April 3, 2023, and ending on April 25, 2023. The Grand Opening Period begins on April 26, 2023.
Trademark owners who had previously registered their trademarks in Myanmar through Declarations of Trademark Ownership (DTO) and/or the publication of cautionary notices, or who had been using their marks in Myanmar before March 31, 2023, could take advantage of this short window period to re-file their applications;
The official filing fees and a notarized Power of Attorney must be paid for any re-filed trademarks during the soft opening period in order to have a filing date that corresponds to the Grand Opening date. Anyone interested in obtaining trademark protection in Myanmar as of 26 April 2023 may file their trademark applications through a fully authorized local trademark representative.
