The difference between the Vietnam Copyright Office and the National Office of Intellectual Property of Vietnam

What are the difference between the Vietnam Copyright Office and the National Office of Intellectual Property of Vietnam? Both these agencies have the function to protect intellectual property assets for the registrants. However, the applicants themselves when trying to protect their rights regarding trademarks will have a hard time figuring out which agency is suitable for their specific type of IP asset.

A brand is an integral part of a business. In Vietnam, on the other hand, there is no clear definition of a brand. A brand is made of many aspects, in which trademark plays the most important role.

That’s the reason why trademark registration is very crucial when a business wants to expand and develop.

It is considered the most valuable intangible asset that can surpass other tangible assets. Therefore, many individuals and organizations want to carry out trademark registration procedures as soon as possible to protect their products.

However, in Vietnam, there are 2 similar IP agencies that have confused Vietnamese registrants for years, even decades. It is the Copyright Office and the National Office of Intellectual Property. 

Although in English, the difference might be clearer but in Vietnamese and in actual practice, many registrants have been confused about the nature of these 2 agencies.

The difference when registering for trademark protection at the Copyright Office of Vietnam and the National Office of Intellectual Property of Vietnam is evident in the function of each place of registration.

Vietnam Copyright Office

The Copyright Office of Vietnam is an organization under the Ministry of Culture, Sports and Tourism with the function of advising and assisting the Minister in performing the state management of copyright, related rights, and cultural industry protection throughout the country.

Among its functions, the Copyright Office has the function of granting, re-granting, changing, and invalidating Copyright Registration Certificates, Related Rights Registration Certificates as well as the complaints and denunciations about copyright and related rights in accordance with the law. Therefore, the Copyright Office is the agency that performs the registration of copyright and related rights works, not the registration of trademark assets.

National Office of Intellectual Property of Vietnam

The National Office of Intellectual Property (NOIP) is an agency directly under the Ministry of Science and Technology, performing the function of assisting the Minister of Science and Technology in unifying state management and ensuring specialized non-business activities on intellectual property nationwide.

Among its functions, NOIP has the function of performing the registration of protection of industrial property subjects such as inventions, utility solutions, industrial designs, trademarks, integrated circuit layout designs, geographical indications, etc., and management of these industrial property subjects throughout the territory of Vietnam.

This agency is in charge of trademark registration in Vietnam.

In conclusion, if the applicant wants to register for copyright protection, they can do it at the Copyright Office. On the contrary, if they want to register for trademark protection as well as nearly all other types of IP assets, they would do it at the National Office of Intellectual Property of Vietnam.
