It’s not difficult to find a song on social media. Children’s songs, revolutionary music, young music songs, and classic songs can all be arranged and shuffled with other lyrics to turn them into another work – normally called parody songs or modified songs. This is a kind of remake of the work and/or republishing it on the Internet, infringing upon the rights of the original authors. Although the infringement is clear on social media sites, however, is that type of music an infringement if it is used by news stations under the Government?

Parody songs may exist as jokes with the main purpose of helping to create fun and humor. However, not all of the songs are for entertainment and not for profit. In fact, most of these songs are created with the purpose of gathering some kind of revenue without the consent of the author.

These actions are determined as an infringement of copyright law, or more specifically, Intellectual Property Law.

Songs derived from the original work must obtain permission and consent from the author himself/herself to make such a work. Normally, when using such works for performance, it is necessary to pay full copyright fees to the authors or his/her representatives/companies. Modified music used for any purpose is illegal, especially if the song is for mocking or damaging the original content.

How to use parody music without infringing copyright?

The effects of derivative works from the original work cannot be denied. Making lyrics from other people’s songs is a form of derivative work.

Therefore, when a news station run by the Government issues programs that have the original work or the modified work of an author, technically it will still be considered a violation of the law as the Government is not above the laws.

Accordingly, the news station as well as any other parties who want to use the work of someone else needs to ask permission beforehand and pay remunerations as agreed upon.

For news stations, due to the emergency nature of giving news reports worldwide, they might cut the phase of asking permission and remuneration.

Specifically, the news station will contact the author of the work first and get a brief acknowledgment of the content to use such contents in their TV programs. Then, after the TV program is aired, the news station will work on the remuneration agreement with the author.

It’s not that just because the news station belongs to the Government, they wouldn’t have to pay anything to air the program with an author’s song. Everything has to follow the rules, especially to the Government.

If the Government did in fact make a violation of the law by mistake or intentionally, rights holders can contact a lawyer specializing in IP rights to get help via consultation or acting as their representative to sue the violating agencies.
