China’s Beijing Internet Court Decides First Copyright Dispute Involving AI-Generated Image

The Beijing Internet Court has issued an initial verdict on the inaugural copyright case within the realm of AI-generated images. The Court ruled that the actions of the defendant amounted to infringement, mandating a public apology and a compensation payment of 500 yuan.

According to the court’s judgment, the plaintiff, Li XX, an owner of a Chinese Xiaohongshu social media account, utilized the open-source software Stable Diffusion in February to create an image through text input and subsequently posted it on the Xiaohongshu platform.

In March, the defendant, Liu XX, utilized the unauthorized image by removing the Xiaohongshu watermark in her post on Baijiahao, a blog-style platform under Baidu.

In response, the plaintiff filed a copyright infringement lawsuit against the defendant at China’s Beijing Internet Court, seeking a public apology and 5,000 yuan in compensation.

The case was heard by the Beijing Internet Court in late August, and a recent judgment favored the plaintiff.

The court argued in its decision that the plaintiff configured the AI model settings based on their requirements and ultimately chose the figure in the image. The disputed image was generated from the plaintiff’s intellectual input, reflecting their personalized expression. Consequently, the plaintiff is recognized as the author of the image and holds its copyright.

The court further determined that the disputed AI-generated image demonstrated “originality” and should be categorized as a work protected by copyright law.
