Accelerated Patent Grant collaboration between the U.S and Mexico

The recently introduced Accelerated Patent Grant (APG) collaboration between the U.S. Patent and Trademark Office (USPTO) and the Mexican Institute of Industrial Property (IMPI) is set to create expanded opportunities for U.S. businesses. Published on November 13, guidelines for the APG outline a work-sharing initiative allowing eligible patent applicants to opt for an expedited process in Mexico, based on a U.S. patent grant.

Kathi Vidal, Under Secretary of Commerce for Intellectual Property and Director of the USPTO emphasized the significance of expediting patent grants, particularly benefiting startups and small businesses. The APG initiative allows companies to swiftly protect their ideas, secure funding, and bring innovations to market. This collaboration with Mexico, one of the United States’ major trading partners, is expected to generate new possibilities for businesses in both countries, fostering economic activity through crucial intellectual property (IP) protections.

In the APG process, eligible patent applicants granted a U.S. patent by the USPTO can select IMPI to grant a corresponding patent on a Mexican patent application at any point during its processing. This choice can be exercised following the application’s publication in the Mexican Industrial Property Gazette, adhering to Mexico’s relevant patent laws. The APG work-sharing arrangement is effective immediately, with IMPI providing guidelines and a user guide in English and Spanish on their website.

The Accelerated Patent Grant work-sharing arrangement joins other collaborative initiatives between the USPTO and Mexico, including the Patent Prosecution Highway pilot program, the Patent Parallel Grant Agreement, and the Electronic Priority Document Exchange. These efforts underscore the importance of the U.S.-Mexico relationship, following the joint statement of intent signed on August 7, 2023, by Director Vidal and IMPI Director General José Sánchez Pérez.
