The battle between 3 American stars regarding the ‘Queen of Christmas’ trademark

Mariah Carey – a famous American singer, songwriter, actress, and record producer recently rolled herself into a trademark battle when she attempted to trademark the mark ‘Queen of Christmas’ to the USPTO.

At least 2 other celebrities have voiced their protest against the trademark registration of the “Queen of Christmas” mark to the USPTO (United States Patent and Trademark Office) filed by Mariah Carey.

One of them even filed a declaration to the USPTO themselves, not just words or threats posted on Twitter and Instagram, taking a legal battle with the famous singer.

Mariah Carey’s trademark

Mariah Carey wrote the song “All I Want For Christmas Is You” back in 1994. The song was later republished in 2009 on Youtube. This song has continued to become famous until this very day, repeatedly reaching the top songs chart after 30 years after its debut.

Due to its popularity, Mariah Carey has decided to file trademark registration applications for the terms “Queen of Christmas”, “QOC”, “Princess of Christmas” and “Christmas Princess” with the USPTO. The formality of the application passes through and on July 12, 2022, the application was published publicly, waiting for opposition by third parties according to the rules of trademark registration in the USA.

The description of the application said that the mark will be used on products including audio and video recordings, clothing, fragrances, food and drink products, Christmas tree decorations, face masks, and other items.

On August 15, 2022, Carrey’s trademark registration has been opposed publicly by Darlene Love and Elizabeth Chan.

Darlene Wright, known professionally as Darlene Love, is an American singer and actress. She has a few Christmas theme songs such as “White Christmas”, “Winter Wonderland” and “Christmas (Baby Please Come Home)”.

Elizabeth Chan is even more dedicated to Christmas. She only sang Christmas theme songs throughout the period of her singing career. She is known unofficially as the “Queen of Christmas” who has written over 1000+ Christmas songs.

Elizabeth Chan in public viewing has even more claims for the “Queen of Christmas” title and trademark in comparison to Mariah Carey. Subsequently, Elizabeth Chan has filed an opposition through her lawyer, Louis W. Tompros, a Boston-based partner at WilmerHale to the trademark registration of the mark.

In an interview with Variety newspaper, Chan expressed her anger clearly at the trademark registration by Mariah Carey, even quoting claims and reasons why the application should be denied: “Christmas has come way before any of us on earth, and hopefully will be around way after any of us on earth. And I feel very strongly that no one person should hold onto anything around Christmas or monopolize it in the way that Mariah seeks to in perpetuity. That’s just not the right thing to do. Christmas is for everyone. It’s meant to be shared; it’s not meant to be owned.”

Perhaps, because of this view that Chan has never intended to register the trademark “Queen of Christmas” although she has been called or regarded many times by this title in her carrier.

Darlene Love, after Elizabeth Chan’s interview, has also expressed her anger to the registration, stating: “Is it true that Mariah Carey trademarked ‘Queen of Christmas’? What does that mean, that I can’t use that title?. David Letterman officially declared me the Queen of Christmas 29 years ago, a year before she released ‘All I Want for Christmas Is You,’ and at 81 years of age, I’m NOT changing anything. I’ve been in the business for 52 years, have earned it, and can still hit those notes!”
