USPTO to Begin New ID Verification Program for Trademark Filers in January 2022

Users who file under a sponsor will not have to go through the identity verification process. Foreign USPTO.gov filers (those without a United States Government-issued identification) cannot have their identifications verified automatically through the verification wizard detailed below, and will instead be forwarded to a live “referee” for a web conference to verify identification when attempting to have their ID – verified.
Account holders with a USPTO.gov account do not need to validate their identify, but everyone who wants to file an application must verify their account with a government-issued form of identification, including unrepresented owners (even if they previously had an attorney). The name on the government-issued ID used to validate the account must match the name on the USPTO account, which cannot be changed unless special circumstances apply (i.e. an official government-recognized name change).
The USPTO is using a third-party identity verification provider (“Id.me”) to conduct online identity verification using a wizard. It’s necessary to have a gadget with a front-facing camera and internet access. A social security number, a selfie taken using the front-facing camera, and a photo of a government-issued ID will be required by the verification wizard. After that, the software will perform a mild credit check to confirm the user’s identity.
If the identification verification through the wizard fails, the user will be redirected to a live “referee” for a web conference to confirm their identity. For those who are unable to complete the online verification process or wish not to use it, a notarized-paper ID verification process is available.
