The Supreme People’s Court Releases a report On The Protection Of Intellectual Property By Chinese Courts In 2021

During the 2022 intellectual property publicity week, the SPC conducted a press conference on April 21 and released a report on the status of the protection of intellectual property rights by Chinese courts in 2021. The study outlined the developments in judicial IP rights protection over the previous year.

The SPC issued a number of judicial interpretations throughout the year, including the Provisions on Several Issues Concerning the Application of the Law in Civil Cases Relating to Applications for Patent Rights in Respect of Pharmaceutical Products and the Several Provisions on the Application of the Law in the Trial of Cases Relating to Plant Variety Rights I. The Interpretations aim to standardize adjudication criteria, which will assist the Courts in effectively addressing potential new issues and difficulties in the area of intellectual property.

The courts accepted a total of 642,968 IP-related cases, including first, second, and retry cases, and 601,544 cases were resolved (including carried-over cases from last year), reflecting an increase of 22.33 percent and 14.7 percent respectively year over year.

The SPC actively participated in the efforts being made to combat IP infringement and counterfeiting. To enable a successful interface between administrative enforcement and the judiciary, it set up liaison and communication channels with the CNIPA and the National Anti-monopoly Bureau. Additionally, it fully utilized the online dispute resolution and mediation platform that was jointly built with the CNIPA. Local courts allocated over 20,000 IP cases to this platform for pre-litigation mediation.

The Plan for Judicial Protection of Intellectual Property by People’s Courts (2021-2025), which was created and published by the SPC, outlines the objectives, duties, and actions related to judicial protection of intellectual property rights in China over the ensuing five years.
