Myanmar: Update on Industrial Design Law and Copyright Law
The State Administration Council (SAC) of Myanmar published notifications on October 18, 2023, detailing the date on which the 2019 laws pertaining to industrial design and copyright will go into effect. The Industrial Design Law and the Copyright Law go into force on October 31, 2023, according to Notifications No. 217/2023 and No. 218/2023, respectively. The country’s industrial designs and copyrights now have a substantial protection system in place thanks to these notifications.
In preparation for implementing the Industrial Design Law, Myanmar’s Ministry of Commerce had previously released the Industrial Design Rules on September 29, 2023. These rules outline the procedures and guidelines for registering industrial designs under the new law. The next step in the process will involve the publication of application forms and official fees for handling matters related to industrial designs by Myanmar’s Intellectual Property Department (IPD). This step is expected to be taken soon, now that the law’s effective date has been confirmed. As a result, rights owners are encouraged to review their portfolios and gather the necessary documentation for applying for registration, and securing statutory rights for their industrial designs in Myanmar.
The protection of copyrights in Myanmar occurs automatically, without the need for mandatory registration. However, with the introduction of the new Copyright Law, which replaces the old Copyright Act of 1914, rights owners will have the option to voluntarily record their copyrights within the framework established by the new law. These records can serve as stronger evidence of ownership in disputes concerning copyrighted works.
