China’s sharp increase in patent inventions numbers in 2021

At a recent conference, the China National Intellectual Property Administration (NIPA) has announced that there has been a total of 696,000 inventive patents approved in 2021, indicating China’s sharp increase in patent inventions numbers in 2021.

At the conference, Shen Changyu – the head of NIPA, has presented a work report summarizing recent developments in the field of intellectual property rights (IPR) of the country.  

IP rights have and always will be an important right of society. With IP, innovation can be made and protected. With a strong foundation of innovation, society can thrive and develop with great speed. 

Accordingly, it is a major focus of every society to develop IP protection and enforcement. 

China, in 2021, has achieved part of this goal. In 2021, there have been 696,000 inventive patents approved and 73,000 foreign patent applications submitted under the Patent Cooperation Treaty (PCT).

With regard to other IPs, China has received 5,928 international trademark applications via the Madrid System and registered 13,000 integrated circuit layout designs last year. 

China transforming into a patent empire

With the new changes in the patent system, the examination time of high-value invention patents and the average examination cycle of invention patents have both been shortened noticeably. 

In terms of IPR protection, the number of administrative rulings on patent infringement disputes saw a year-on-year increase of 17.4 percent in 2021. 

The establishment of 25 new protection centers and rapid rights protection centers was approved. 

According to the report, the new changes have made the public’s satisfaction with IPR protection grew to 80.61 points.

The added value of China’s patent-intensive industries hit 12.13 trillion yuan (about 1.9 trillion U.S. dollars) in 2020, accounting for 11.97 percent of GDP, an increase of 0.35 percentage points over the previous year.

China’s 15-year plan (2021-2035) on IPR development has clearly set the goal that the added value of patent-intensive industries accounting for 13 percent of GDP by 2025. 

China has also carried out 37 high-level bilateral and multilateral cloud conferences, with 244 China-EU geographical indications being mutually recognized and protected. 

Expert opinions

Shuhua Zhang, a partner at WAN HUI DA Intellectual Property in China, has stated about the development of IP, particularly patent in China in comparison with 2020 that the amount of granted patents, including invention patents, utility models, and design patents, have all increased in 2021: Granted invention patents: 0.696 million in 2021 v. 0.53 million in 2020; Granted utility model patents: 3.12 million in 2021 v. 2.377 million in 2020; and Granted design patents: 0.786 million in 2021 v. 0.732 million in 2020.

However, he also added: “But as to whether or not the amount of patent applications has also increased in 2021, there is no official data. And the CNIPA has deliberately chosen not to release the data of patent applications in 2021. One background is that in the past years the amount of patent applications has increased to an “abnormal speed”, largely due to local governments’ various incentive measures (financial subsidies). To curb the “abnormal patent applications”, Chinese governments have decided to cancel most of the financial subsidies. Besides, the CNIPA has launched the “Blue Sky” campaign in early 2021 to fight “abnormal patent applications”. According to an official news release, in this campaign altogether 0.85 million patent applications were withdrawn.”
