China: 2023 Outline for Strengthening Intellectual Property Rights & Implementation Plan
The 2023 Outline of Building Strong Intellectual Property Rights System and the Implementation and Promotion Plan of the 14th Five-Year Plan have been released to advance the strategy of bolstering the IPR system and delineate the pivotal tasks and strategies for the year ahead. Issued by CNIPA, the outline outlines 139 key tasks across seven major areas.
Regarding the enhancement of the intellectual property system, the plan emphasizes the improvement of IP laws and regulations, the overhaul of major IP policies, and the enhancement of IP regulations in emerging sectors. Specific measures include advocating for revisions in relevant laws, establishing a top-tier patent and trademark examination institution, and expediting the formulation of IPR data protection guidelines.
In terms of strengthening IP protection, the plan calls for bolstering judicial and administrative safeguards while enhancing collaborative protection schemes. This entails reforms in the appeal and trial mechanisms for IP cases, specialized guidance for trademark and patent enforcement, and the establishment of high-standard national IP protection zones.
To improve the operational mechanisms of the IP market, the plan emphasizes elevating the quality of IP creation, promoting comprehensive IP applications, and fostering market-oriented IP operations. This involves improving the IP assessment and evaluation mechanisms, nurturing patent-intensive industries, and advancing the implementation of patent conversion initiatives.
In the realm of improving IP public services, the plan underscores the need to enhance service provision and efficiency. This includes promoting the open sharing of IP data and enhancing the management of IP public service institutions.
Additionally, the plan delineates measures to create a favorable cultural and social environment for IP, engage actively in global IP governance, and reinforce organizational protection.
