Kazakhstan launches new Blockchain-based copyright protection platform

In late 2023, Future NFT Technology, a Kazakh company, introduced the Central Asian Intellectual Property Registry (CARRIP), a blockchain-based platform designed for copyright registration and protection specifically catering to Kazakhstan residents.

Utilizing blockchain technology, CARRIP securely stores registered creative works, ensuring transparency and bolstering copyright protection through encrypted blockchain mechanisms. Additionally, the platform enables users to grant permission for the use of their copyrights under specified conditions, with authors receiving a copyright registration certificate upon payment of a fee.

According to Saule Akhmetova, partner and branch director at GRATA International in Almaty, CARRIP stands out for its simplicity, user-friendliness, and accessibility compared to other repositories, offering swift authorship confirmation within minutes. Akhmetova highlighted the transformative potential of blockchain in streamlining the registration process for industrial property and intellectual creative activity, citing its ability to enhance data integrity and authentication, mitigate counterfeiting, facilitate property licensing via smart contracts, and simplify trademark registration.

However, Akhmetova cautioned that while CARRIP holds promise, its efficacy within the law enforcement and judicial system remains to be fully realized. She noted that authors often prefer to register their intellectual creative activity results in the State Register of Rights to Copyrighted Objects of the National Institute of Intellectual Property of the Ministry of Justice of the Republic of Kazakhstan, as it provides personal non-property rights verification.

Post-registration, the Expert Organization issues a copyright certificate in the State Register of Rights to Copyrighted Objects, an official state document recognized for legal purposes. Conversely, a deposit certificate, while indicative of the work’s existence at a specific time, is non-binding. Akhmetova emphasized the enduring preference for the copyright certificate issued by a trusted state body.

Regarding its alignment with Kazakhstan’s copyright protection framework, Akhmetova clarified that while Kazakh legislation acknowledges the concept of depositing works, it does not specify the depositing procedure itself. Depositing works is voluntary and lacks legal consequences, with depository organizations operating according to internal rules and retaining the right to refuse applicants.

CARRIP, which amassed hundreds of copyright registrations within 60 days of its launch, is poised for expansion into Kyrgyzstan, Tajikistan, Turkmenistan, and Uzbekistan.
