Establishing Patent Prosecution Highway between South Korea and Indonesia
Indonesia and South Korea have established a Patent Prosecution Highway (PPH), enabling applicants to pursue patent protection in Indonesia with a granted Korean patent as the basis for their application.
This PPH initiative resulted from the signing of two Memoranda of Understanding (MOUs) between Indonesia’s Directorate General of Intellectual Property (DGIP) and the Korean Intellectual Property Office (KIPO) on September 8, 2023. One MOU outlines comprehensive cooperation in intellectual property, while the other delineates the specifics of the PPH mechanism.
Upon request, the PPH facilitates an expedited examination process for patent applications in Indonesia, utilizing the substantive examination results issued by KIPO. This has the potential to significantly reduce the examination period from approximately two years (from the substantive examination request) to less than one year (from the PPH request).
Similar to the existing PPH agreement for Japanese patents in Indonesia, applicants can submit a PPH request based on a granted Korean patent after the publication of the Indonesian patent application and before receiving the first office action. A prescribed official fee of IDR 5 million (approximately USD 315) is required for filing a PPH request.
The broader cooperation outlined in the second MOU between DGIP and KIPO encompasses enhancing both countries’ capabilities, frameworks, protection, inspection, and utilization of intellectual property. Additionally, they will exchange information to raise public awareness about the importance of intellectual property protection.
