The procedure of trademark renewal in South Korea
The duration of the protection of a trademark right in South Korea is 10 years from the date of registration of the trademark, which may be renewed every 10 years. For the renewal of trademark registration, an application for the renewal should be filed at KIPO.
A renewal application should be filed within 1 year before the expiration date. The renewal can be requested within the year before the expiration date.
In case of late renewal of registration, it should also be noted that if the trademark owners forgot to file for renewal, they may still file for a renewal of their trademark in a grace period of 6 months after the expiration date with an additional late payment fee.
The processing time from first filing to registration is approximately 9-12 months in the case of a smooth registration procedure.
A certified copy of the Priority Document alongside the Korean translation should be submitted within 3 months from the date of filing the trademark application in the Republic of Korea. This term cannot be extended.
It is recommended to submit a scanned copy of the Power of Attorney simultaneously with filing the trademark application in the Republic of Korea. If not submitted upon filing, the KIPO will issue a notice to file and stipulate a time period in which to file the POA. Official legalization is not required.
In the case of failing to renew a trademark, the registrar will issue a notice in the Trademark Journal indicating the removal of the trademark.
