The procedure of trademark renewal in Cambodia
A trademark is protected in Cambodia for 10 years from the filing dates and may be renewed every 10 years. No letter of notice will be sent to the trademark owner reminding them of their duty to renew their trademark.
The application for renewal of the registration of a mark may be filed within six months preceding the expiry of the registration. Late renewal is possible within a six-month grace period after the end of the validity period of the registration with a late renewal fee.
The registration of renewal will not be granted if the owner of the registered mark or their legal representative fails to submit the request for Affidavit of use/non-use in the sixth year. If no Affidavit of use/non-use is lodged, the trademark will be vulnerable to cancellation at a third party’s request. Therefore, it is necessary to file an affidavit of use or non-use in the fifth year of registration.
The time limit for filing an opposition is within 90 days. If no opposition is submitted, a Certificate of trademark registration shall be issued. Generally, it will take about 4 to 12 months as of the official filing date for obtaining a Certificate of trademark registration.
Certificate of Trademark Registration is usually granted within 6-8 months from the filing date.
