ST24, ST25 rice of Vietnam gained trademark protection in the Australian market

ST24, ST25 rice – Vietnamese rice brands on the international stage have recently been registered for trademark protection in the Australian market. This protection officially marks one of the most glorious moments for Vietnam as well as the intellectual property law industry in this country.

On June 7, 2021, law firm Baker McKenzie represented Ho Quang Tri private enterprise to apply for trademark registration for 3 trademarks ‘GAO ONG CUA VIET NAM’, ‘GAO ONG CUA VIETNAM ST24 RICE’, ‘GAO ONG CUA VIETNAM ST25 RICE’ to the Australian Intellectual Property Office.

The above brands all have images and logos that are quite similar to each other through the image of a man wearing glasses, a long, black beard smiling with a golden rice top next to it. The official description is: MAN’S HEAD,SMILING WEARS SPECTACLES BESIDE GRAIN,EAR, ALL ATOP RICE,STYLISED.

Trademark registered for group 30 on Rice; rice residue for culinary purposes; string made from rice (food); rice vermicelli; rice snacks; edible rice paper; food products extruded from rice.

ST24, ST25 are trademarked in Australia

Under Australian IP law, the above trademarks will have a term of protection of 10 years from the date of filing. It should be noted that there are differences between the filing date and the registration date.

Accordingly, in this case, all 3 trademarks were filed for registration on June 7, 2021, and therefore will have a term of protection of 10 years from this date, expiring on June 7, 2031.

The successful registration date is September 27, 2022, after more than 1 year of evaluation and approval of the application content. The date of registration will not have a significant effect on the validity of the trademark.

By June 7, 2031, if Ho Quang Tri wants to continue to extend the protection term of the above 3 trademarks, they will have to file a request to renew the trademark for another 10 years, until 2041.

There are no restrictions on the extension of trademark protection. Accordingly, Ho Quang Tri enterprise can continuously renew the trademark every 10 years.

Affect

ST24, ST25 are Vietnamese rice brands on the world stage. When foreigners think about Vietnamese rice, they won’t think of Bac Huong rice, sticky rice, fragrant rice of Huong Lai,… or any other traditional rice but only know ST24, ST25 as these 2 types of rice have won many prestigious rice awards in the world.

The registration of trademark protection in the Australian market marks the first time that a famous Vietnamese rice brand has been trademarked in Australia.

“As soon as rice was granted trademark protection, we cooperated with our partner in Australia to export the first 2 containers with 46 tons of rice to this market. Currently, the product is sold in a supermarket system in this country,” said private enterprise representative Ho Quang Tri.

In fact, Vietnam is said to be relatively slow to enter the Australian market because, in April 2021, an Australian business named “T&L Global Foods Supply” submitted a trademark application for ST24, ST25 rice with the Australian Intellectual Property Office.

The purpose of this business is basically to blackmail Ho Quang Tri enterprise when they decided to expand into this market.

However, this plot was destroyed when the Vietnam Trade Office in Australia informed and sent a note to the Australian authorities protesting this registration.

Not only the Australian market, Mr. Ho Quang Cua – the owner of the Ho Quang Tri private enterprise has also expanded the trademark protection market to the EU and the UK with the trademark “Gao Ong Cua”.
