Malaysia sets clear boundary on works created by AI in relation to other copyright-protected works
The chairman of the Intellectual Property Corporation of Malaysia (MyIPO), Mohd Zuhan Mohd Zain, revealed that individuals using artificial intelligence (AI) apps to generate material resembling content eligible for inclusion in the nation’s intellectual property register could still face legal action.
This disclosure was made during a recent media gathering associated with the National Intellectual Property Awards 2024 (AHIN2024). Zain emphasized that all intellectual property (IP) in Malaysia is safeguarded under various acts including the Trademarks Act 2019, the Patents Act 1983, the Copyright Act 1987, and the Industrial Designs Act 1996.
Zain provided an example, stating that even if AI-generated lyrics are used, it could constitute infringement if those lyrics are already copyrighted by a publisher.
Additionally, Zain mentioned that MyIPO will address concerns regarding specific standard operating procedures (SOP) for AI applications at the upcoming World Intellectual Property Organization (WIPO) conference scheduled for July in Geneva. One of the key concerns is whether individuals utilizing AI tools could be held accountable for copyright-related actions.
Furthermore, Prime Minister Datuk Seri Anwar Ibrahim disclosed MyIPO’s involvement in establishing the First National Artificial Intelligence Learning Center in collaboration with the AI Faculty at Universiti Teknologi Malaysia (UTM).
Anwar stated, “We will engage with UTM soon regarding the establishment of the AI Faculty, as individuals using AI must understand the instructions provided by AI in practice. We will collaborate with them, insha’allah, to ensure that the details and new innovative aspects developed under that AI faculty are subsequently aligned with MyIPO.”
