Required documents of trademark renewal in China
Trademarks registered in China from CNIPA have a term or validity period of 10 years. You need to renew it within 12 months after it expires.
Usually, there are three ways you can renew your trademark. One is that you can renew the mark with the help of your attorney, you need to pay additional fees, but it is safe and efficient and one Power of Attorney is needed to prepared.
Another way is that you or the owner can go to the CNIPA trademark office and submit the renewal application papers. The third way is that if the owner is familiar with the CNIPA online service.
Required documents
- The application or owner personal information such as ID card, passport information, etc. It need clearly show that the trademark owner on certification is same as you ID card or passport.
- The copy file of the original trademark certification
- The translation papers if the owner is one foreigner
- Power of attorney is a required document, if the owner works with the help of a law office
Other Notes:
- In submiting the files for trademark renewal application: If you have the attorney who have done the trademark renewal process, all papers will be submitted to CNIPA trademark office by the attorney. If you go to the CNIPA local office to submit, prepare all papers ready and sumbit them.
- Trademark renewal fees: it cost 1000 RMB for one trademark renewal application in China, if the owner miss the grace period- 6 months in China, the will be a surcharge of 250 RMB.
