Required documents for Trademark renewal in India
Once registered, a trademark application must be renewed every ten years, or the trademark will be deleted from the Register of Trademarks. A trademark renewal application must be made using Form TM-R and the stipulated fee of INR 9000 per class within one (1) year after the expiry of its registration. Failure to submit the required fee with the Form TM-R may result in the trademark being removed from the Register.
If no application for renewal of a trademark is filed with the prescribed fee, the Registrar shall send a notice to the proprietor of the trademark at the prescribed address of service alerting him or her of the renewal deadline.
Applicants must have an address in India for service. It is suggested that overseas applicants conduct trademark prosecution in India through a registered trademark attorney in India.
