Procedure of Trademark Renewal in Indonesia
A trademark is protected in Indonesia for 10 years from the filing dates and may be renewed every 10 years. An application for renewal of a trademark must be filed within 6 months before the expiry date of a trademark.
Late filing of the renewal application may be done within a 6-month grace period after the expiry date of registration by paying an additional fee. Besides, a Power of Attorney is necessary for Trademark Renewal in Indonesia.
Prior to the expiry date, The registrar will issue a late renewal notice, which will be sent to the owner and their agent if any. The Application for renewal is filed electronically or non-electronically in the Indonesian language by the Mark owner or his/her Proxy within six months before the expiry of protection of the registered Mark and subject to fee.
If the trademark is not renewed before the expiration date, then a new, independent application will have to be filed in order to obtain protection for the trademark.
If no request for restoration and renewal is made within 6 months after the date of the removal of the trademark from the register, the mark will be reflected as “Removed”. The Registrar will check whether the notice has expired, if a trademark is not used for three consecutive years, the trademark registration can be cancelled at the request of a third party or on the initiative of the Indonesian IP Office. Once a trademark has been expunged, it can no longer be reinstated.
Request for trademark renewal shall be filed within a period of not more than 12 (twelve) months before the expiry of the protection period of your registered trademark. A standard trademark renewal requires between 12 and 18 months to complete.
