New updates on Thailand Fast-Track system for trademark matters

Recently, Thailand’s DIP (Department of Intellectual Property) has issued a Fast Track system for Trademark Registration Fast-Track system and Trademark Renewal Fast-Track system which has come into effect from 23rd February 2021.

Trademark Registration Fast Track System

Previously, the timeframe for Trademark Registration as per the DIP Manual is about 16 months. Nowadays, trademark applications that meet the two required conditions will automatically be reviewed, provided if no additional request is required, as per the DIP’s new Fast-Track Declaration. Under the new Trademark Registration Fast-Track System, the timeframe for Trademark Registration takes only 6 months. The two required conditions are:

  1. The total number of goods/services must not exceed 30 items.
  2. Goods/services must be selected from the DIP Website (https://tmsearch.ipthailand.go.th).

Trademark Renewal Fast Track System

Previously, the usual timeframe for Trademark Renewal as per the DIP Manual is between 3-6 months. Nowadays, the renewal process for qualifying trademarks in Thailand got significantly faster. The examination of applications and grant of a certificate of renewal now able to be completed within 45 minutes of a renewal application being filed. Furthermore, the whole expedited process demands no additional official fee.

The five required conditions are:

  1. The total number of goods/services must not exceed 30 items.
  2. No changes have been made to the particulars of the trademark registration., i.e. change of name or address, re-classification of goods, etc. will render the mark ineligible for fast-tracking.
  3. The Renewal Application must be filed at the DIP by either the (1) owner, (2) an appointed attorney (general or specific); whereby, in the latter case, the Power of Attorney (POA) must authorize the attorney to (1) file the Renewal Application and (2) collect the Certificate of Renewal on the owner’s behalf.
  4. Fast Track examination must be requested with the DIP Officer at the time of filing the Renewal Application.
  5. All the required Official Fees of the Renewal Application are fully paid.

This new advancement of DIP is considered to be very brand-owner friendly and business-oriented. This new system will also allow trademark-related transactions to be conducted smoother and more seamless, especially with the trademark assignments and the records of change of name or address.

New update on the Fast-Track system

On 5th April 2021, the Department of Intellectual Property of Thailand (DIP) announced two notifications regarding the Trademark Registration Fast Track System and the Trademark Renewal Fast Track System. 

Fast-track examination for new trademark applications

Under the “First Action Fast Track” announced by the DIP, any trademark application that meets the following standards will receive the first office action (or proceed to publication) within six months from the filing date.

  1. The application contains ten or fewer items of goods/services.
  2. All items specified are included in the DIP’s guideline (available athttps://tmsearch.ipthailand.go.th/). To assist foreign trademark owners, the DIP has translated parts of the goods/services into English. 
  3. There is no recordation or amendment to the application within six months after the filing date – such as records of assignment, records of name or address change, amending the list of goods, etc.

The “First Action Fast Track” automatically applies to all applications that meet the above standards. There is no requirement for extra demand or payment.

Fast-track examination for renewals of trademark

Under the “Fast Track Renewal”, any trademark owner may request the examiner to renew a trademark registration within one hour if the following criteria are met:

  1. The trademark registration contains 30 or fewer items of goods/services.
  2. There is no recordation or amendment to the trademark registration – such as records of assignment, records of name or address change, amending the list of goods, reclassification, etc.
  3. All required documents are submitted at the time of filing.

To use the “Fast Track Renewal” system, the trademark owner may simply notify the examiner upon renewal. There is no requirement for an extra payment.
