Facebook in trouble of losing control over the ∞ logo
For many years, Facebook has been a highly visited site on the internet, and its evolution has been widely observed by the public. In a notable move in 2021, the company changed its name to Meta Platforms, garnering international attention. However, the transition to the Meta brand has encountered a significant obstacle related to a pre-existing Meta trademark.
Nearly two years ago, the company, now Meta Platforms, initiated the trademark registration process for its new Meta logo. This logo incorporates the word “Meta” alongside a geometric design featuring two loops, resembling the letter “M” and the infinity symbol (∞). However, Meta Platforms faces a challenge as MetaX LLC, a company specializing in virtual and augmented reality immersive experiences, filed a trademark opposition against the social media giant on December 14, 2023.
MetaX argues that the registration of Meta’s logo would infringe on its existing Meta trademark, which involves the word “Meta” preceded by a three-dimensional “M” letter. The visual similarities between the two logos are acknowledged, but this trademark dispute is part of a broader legal conflict.
The ongoing litigation between MetaX and Meta Platforms is part of a larger battle initiated when Facebook rebranded to Meta. Several companies, including MetaX, had already secured trademark rights for the term “Meta.” When MetaX took legal action against Meta Platforms in July 2022, legal experts anticipated challenges due to the significant financial resources of the rebranded company.
In addition to the dispute with MetaX, Meta Platforms faces legal challenges from other entities, such as Metacapital and a staffing and tech company called Megabyte. The attempt by Meta Platforms to secure the Meta trademark is viewed critically by legal scholars, with accusations of potential “trademark squatting” and claims that the company sought to trademark “Meta” for medical masks in a questionable manner.
The lawsuit filed by MetaX introduces crucial aspects to the legal battle. It alleges that discussions about a partnership between MetaX and Facebook occurred in 2017, where Facebook representatives expressed admiration for MetaX’s products. Despite this, no partnership materialized, and MetaX engaged in negotiations with Meta Platforms for eight months before resorting to legal action.
According to MetaX, they have been using the Meta trademark since at least 2010, well before Facebook’s rebranding. Given Mark Zuckerberg’s focus on developing metaverse properties, there is potential overlap between the services provided by Meta Platforms and MetaX, leading to concerns about trademark confusion.
The outcome of the trademark dispute with Meta Platforms could become costly, as highlighted by legal scholars. However, MetaX appears prepared to confront the challenges on multiple fronts, not only through the ongoing lawsuit but also by opposing Meta’s trademark and logo. The unique position of MetaX, its history predating Facebook’s rebranding, and the potential partnership discussions create an intriguing legal landscape, and the resolution of this trademark conflict remains uncertain.
